The matter brought up by this person is an employment matter, failing to pay commission/salary, the allegation can be dealt through the employment court, prior to that, most likely it would refer to a mediation, at least once, such matter, chances are it would settle outside the courtroom. There should not be any threats of jail time made by either public prosecutors or any lawyers willing to take on this case. Your bounced check story would be a civil matter relates to breaching of contract law,(alleged in deceit), it’s not relevant to this.
Every state has different laws, but on this matter, the whole western legal systems would have same take dealing on such claims
